Karnataka HC upholds ban on sale of firecrackers within Bengaluru city limits 2022

Karnataka High Court upheld a purchase through the police department to withdraw no-Objection Certificate issued for that purchase of firecrackers inside the limits of Bengaluru city. Interestingly, maybe the very first time ever, a legal court used photographs of individuals hurt by firecrackers for example youngsters and kids who lost their eyesight to firecracker injuries in the judgement.

In the judgement, Court stated around the pages where photographs were placed, “This could result in the Makers from the Metabolic rate to shiver within their grave. There can’t be a larger breach of the authority to existence, limb and liberty,”

The only judge bench from the Karnataka High Court brought by judge Krishna S Dixit rejected a plea filed by a number of traders who’d challenged the choice from the Karnataka Police department to withdraw the NOC.

Bengaluru’s Commissioner of Police had withdrawn the NOC to firecracker sellers this year, that was upheld through the Director General of Police in 2013. Participants then challenged the choice within the high court which gave its decision on This summer 29, 2022.

Karnataka High court while dismissing the petition stated, “Indisputably the harmful effects of firecrackers cause irreversible harm to the atmosphere. Aside from infants, expectant moms and patients (more particularly individuals getting heart condition and bloodstream pressure) even creatures and wild birds too have the violence because of bursting of crackers.”

The judgement further read, “When the petitioners need to shift their ‘apple carts’ to safer areas, quitting the lanes under consideration, other similarly circumstanced businessmen can’t be allowed to cling to the same area. What pertains to goose pertains to gander, as appropriately contended through the counsel for that Condition,”

The rule withdrawing NOC to firecracker sellers will affect all traders inside the Bengaluru city limits and not simply the petitioners.

The only judge bench pointed out that the purchase of firecrackers falls underneath the group of goods like poison, liquor, tobacco, and explosives and can’t be covered underneath the Fundamental Right under Article 19 from the metabolic rate.
